Below you will find the Terms and Conditions (or "Terms of Use") of the website www.agentebtc.com (the "Site"), which, together with the Privacy Policy, form a contract between AgenteBTC.com (Compañia de Activos Digitales S.A.C with RUC: 20606053194, hereinafter "AgenteBTC.com") and the user (hereinafter "you" or the "User"). In these Terms of Use, when we refer to AgenteBTC.com, we include by reference its owners, directors, administrators, investors, employees or any natural or legal person related. Depending on the context, AgenteBTC.com may also refer to the services, products, website, content or any material that AgenteBTC.com provides on the Site or outside of it.

Risks Related to Cryptocurrencies and Use of the Site

The exchange of goods or products, real or virtual, as well as money or currencies, carry with them a significant risk. Their prices may vary over time and due to the occurrence of different events. As a result of these price variations, the value of your assets can increase or decrease drastically at any time and without prior notice.

Likewise, you declare and accept that the exchange of Cryptocurrencies has special risks, which are not necessarily shared by currencies, assets or freely exchangeable products. Unlike the currencies of the rest of the world, which are backed by federal reserves, central banks, governments or other entities, or by commodities such as gold and silver, Cryptocurrencies only have the backing of technology and the mutual trust of the users who own them. That is, there is no federal reserve, central bank, government or other entity that protects their value, and it is achieved exclusively under the balance between supply and demand.

Although it is not our mission nor our intention to define exactly what a Cryptocurrency is and its generation system, we can point out, in a few words, and taking bitcoin as a clear reference, that it corresponds to a global, decentralized and autonomous, self-regulated system, through which a virtual commodity, or digital asset, called Cryptocurrency, is generated and circulated, and whose value is based on the trust that users themselves give to the system.

In this regard, you declare that you know and accept that the trade or exchange of Cryptocurrencies could be susceptible to irrational (or rational) bubbles, be subject to loss of confidence, and consequently could lead to a collapse or crash in their demand relative to supply. Just as an example, since scenarios can be varied, confidence in Cryptocurrencies could collapse due to an unexpected change imposed by a software developer, due to the prohibition that some government or state may impose on it, due to the creation of a technically superior alternative, or simply due to an inflationary or deflationary spiral. Likewise, confidence in Cryptocurrencies could collapse due to eventual technical problems, such as if the money of owners or people who interact or operate with Cryptocurrencies is stolen or lost, or if hackers or governments manage to prevent transactions from being carried out.

Regarding the purchase and sale transactions of Cryptocurrencies, you understand and accept that the price indicated in the purchase/sale quote within AgenteBTC.com is an approximation that can change (even at the time the respective purchase or sale order is placed) as market conditions change. Since it is the clients who through their purchase and sale requirements of Cryptocurrencies in AgenteBTC.com, it is not possible for the latter to guarantee a price in the respective quote. Therefore, once the request has been made and entered into the Platform and they are processed by AgenteBTC.com. Each User is responsible for the asset they are purchasing. Likewise, Users will be responsible for the manipulation or movement of cryptocurrencies from their own wallets.

AgenteBTC.com reserves the right to refuse to process any order to purchase, sell or withdraw Cryptocurrencies or legal tender, at its sole discretion, if AgenteBTC.com suspects that the order involves (or has a high risk of involving) activities related to money laundering, terrorist financing, fraud, or any type of financial crime, or activity that is not in accordance with what is established in these Terms and Conditions; or in case of being required judicially or administratively by some competent authority. In such circumstances, AgenteBTC.com will cancel or refuse to process the order, without any obligation to allow a subsequent order at the same price or on the same terms as the canceled or refused order.

Finally, it should be noted that there may be other risks not considered or identified in these Terms of Use, which Registered Users are willing to bear, releasing AgenteBTC.com from any responsibility for them.

For the above and most importantly, you must carefully analyze your financial situation and your risk tolerance before buying or selling Cryptocurrencies on the Site.

Service Charges, Transaction Costs and Compensation

AgenteBTC.com charges for all transactions that occur within our platform, both purchases and sales (service charge). On the other hand, there may be costs associated with deposits and withdrawals, both legal tender and Cryptocurrencies, which are charged by banks, payment methods, transfer service providers, and the networks of each of the Cryptocurrencies supported by the Platform. AgenteBTC.com reserves the right to modify its service commissions at any time.

The service commission is charged in full at the time of the transaction, so there are no and will be no subsequent charges associated with them.

AgenteBTC.com informs that there are certain transaction costs associated with charges made by the networks or infrastructure behind Cryptocurrencies, such as when withdrawing bitcoins from your Account to your personal Bitcoin wallet. These costs, although adjusted daily by market rules, will be notified to you in advance at the time of requesting the withdrawal. In this regard, any withdrawal in Cryptocurrencies from your AgenteBTC.com account to an external Cryptocurrency wallet must be for an amount at least greater than the network transaction costs, in effect at the time of withdrawal. You declare that you are fully aware of the above and accept it.

In case of having been invoiced service charges, transaction costs or charges that did not correspond, the Registered User must contact our Customer Service team to resolve such situation at soporte@agentebtc.com.

Payment Methods and Deposit

The only authorized payment and deposit method on the Site, unless expressly stated otherwise, may be, although they are not an obligation for AgenteBTC.com, the following:

Bank transfer: These must be made to the bank accounts indicated by AgenteBTC.com and from a bank account owned by the User holder who makes the respective deposit or payment. Transfers from third-party bank accounts are not accepted and failure to respect this restriction will result in the total refund of funds, minus the charges established by AgenteBTC.com's bank, to the same bank account from which the funds come.

AgenteBTC Partners: AgenteBTC Partners are the only entities collecting money on behalf of AgenteBTC.com in cash, once the process of selling digital currencies by our AgenteBTC Partners has started, the transaction cannot be canceled (since operations are irreversible).

It is expressly stated that in compliance with applicable legislation, there is a possibility that advances made by Registered Users will be reported to the respective government agency in charge of controlling money laundering and terrorist financing.

Refunds: Refunds are without effect since once the asset has been made and delivered, no type of refund of funds will be made. The User declares that they understand and accept the above.

Site Availability

You accept and agree that AgenteBTC.com is not responsible for any damage, harm or loss to the Registered User caused by system, server, Internet or Site failures. AgenteBTC.com will also not be responsible for any virus that could infect the Registered User's equipment as a result of access, use or examination of the Site or due to any transfer of data, files, images, texts, or audio contained therein. Users may NOT attribute any responsibility or demand payment for lost profits or any damage, due to damages resulting from technical difficulties or failures in systems, Internet or on the Site. AgenteBTC.com does not guarantee continuous or uninterrupted access and use of the Site. The system may eventually not be available due to technical difficulties or Internet failures, or due to any other circumstance foreign or own to AgenteBTC.com; in such cases it will be sought to restore it as quickly as possible without this being able to attribute any type of responsibility. AgenteBTC.com will not be responsible for any error or omission of content on the Site.

Limited Right of Use

AgenteBTC.com is not responsible for funds acquired towards the wallets it recommends, since AgenteBTC.com does not operate with blockchain or its own wallets, it is only a distributor of cryptocurrencies.

Indemnification

The Registered User will indemnify, keep harmless and defend AgenteBTC.com, its affiliates, subsidiary and controlling companies, and their respective directors, managers, administrators and employees, for any action, claim or demand from other Registered Users or third parties for their activities on the Site or for their own breach of the Terms of Use and other Policies that are understood to be incorporated into the Terms of Use or for the violation of any laws or rights of third parties, including attorney's fees in a reasonable amount.

Modifications to the Terms of Use

AgenteBTC.com reserves the right to modify these Terms of Use, at any time, and those changes will be effective from the moment they are published. AgenteBTC.com undertakes to make reasonable efforts to inform of material changes to the Terms of Use, through the channels that AgenteBTC.com deems appropriate, but it is ultimately the User's responsibility to periodically review the Terms of Use of the Site.

For Other Types of Products

Whether OTC, or any of our services for moving higher volumes of Cryptocurrencies, we offer management and movement. However, we are not portfolio managers or money capturers, our function with these services is to be a facilitator of the operations we carry out, whether national or international.
